PREAMBULE

This site is edited by the company 3 SUISSES FRANCE, SCS (limited partnership) whose head office is located at 4 place de la République 59170 Croix France and who is registered at the Trade Register of Roubaix Tourcoing under the number 475581591.


The present General Terms of Sale define the parties' rights and obligations in the context of sales placed using the site www 3suisses.com. They regulate all of the necessary steps for placing and tracking an order.


These terms only concern physical persons who are not traders, who are at least 18 years old and who have the legal capacity to contract.


Please note that you may save or print the present General Terms of Sale.


3 SUISSES reserves the right to adapt or change the present General Terms of Sale at any moment. In the event of any changes, the General Terms of Sale in force on the day that the order is placed will be applied to each order.


The date of the latest update to the General Terms of Sale is shown at the top of this page.


3 SUISSES is a member of the FEVAD, the Federation of Distance Selling Companies (60, rue de la Boétie, 75008 PARIS) and has formally committed itself to respecting the principles of defence of the consumer set out in the professional charter.

The order

Your order will only be taken into account on the site if have clearly identified yourself by entering your customer number or your e-mail address and password.


You can place your order on-line either using the reference numbers or the offers on the site.


In general, the information concerning the availability of products is provided when you place your order. Occasionally, a product may become provisionally unavailable after an order has been confirmed. In this case, 3 Suisses will warn you of this fact as soon as possibly by e-mail and the article will automatically be cancelled. You will only be charged for the articles that are sent to you or your account will be automatically credited with the amount of the article that became unavailable after you place your order.


Your order is definitively confirmed once payment has been confirmed.


Once you have placed your order, we will send you an e-mail to confirm that we have received the order, with a summary of the articles that you have ordered and the delivery address.


The price is given in Euros. 3 SUISSES reserves the right to modify the prices if the expenses increase (notably the VAT rate) and in the case of obvious error. The products will be billed on the basis of the declared price at time the order is placed.


European Union countries benefit from a tax reduction of 16.39 %. Our stated prices include this reduction.

Reductions

To take advantage of promotional offers, calculate each reduction from your order's total without combining it with other reductions. The reductions are proportionally applied to each product.

To better serve you

In some cases, 3 Suisses will replace an item that is unavailable with another item presenting similar characteristics and of identical or superior quality that has at least the same value. Of course, if you do not want to keep the substituted item, you can return it and automatically obtain a reimbursement for the product and the return shipping cost.

PAYMENT

You can choose to pay for your order by credit or debit card. 3 SUISSES accepts international cards (VISA, MASTERCARD or EUROCARD).


Please indicate the card number, expiry date, and the card holder’s name. For extra security, please indicate the card’s security control number: the 3 last digits of the number on the back of the card, near the signature.

HOME DELIVERY

Orders are delivered to the address indicated at the time the order is placed. In case of absence during a delivery time, the delivery person will leave an attempted delivery notice with a telephone number in order to schedule a new delivery time.


3 SUISSES commits to deliver the available items as quickly as possible using the postal service or a private carrier.


Delivery time cannot be guaranteed in the case of force majeure – particularly in the case of strikes - as defined by law.

MY SECURITY

All the information for your order and your payment are encrypted and sent from your computer to 3 SUISSES according to SSL protocol. Only the 3 SUISSES Company has the encryption keys to read this information and to process your order.


A padlock will be visible on the bottom right of your screen to indicate when you are in the security mode.


If you suspect that your account is being used fraudulently, , we invite you to contact our customer service office as soon as possible. The customer service office will register your complaint and will inform you of the procedures to follow. Except for fault or negligence on your part, you will not be held responsible for fraudulent use.

RIGHT TO CANCEL/RETURNS

If you are not entirely satisfied, 3 SUISSES will reimburse an item up to 15 days after home delivery or reception of the order. Personalised or custom-made items, video or audio recording supplies, and opened software (if the safety seal has been opened) will not be reimbursed.


Certain clothing items are delivered with security seals that need to be left in place when trying on. All items returned without the safety seal in place cannot be reimbursed.


Incomplete, spoiled, damaged, or soiled items will not be accepted.

The set participation amount corresponding to the shipping and handling of the order will not be reimbursed. In the case of a defective item, the price of the item - as well as the set participation and return cost- will be reimbursed.


Please attach the right-hand portion of the delivery slip and keep the left-hand portion, which serves as your guarantee.


The product amount will be reimbursed within 30 days of reception by 3 Suisses.


In the event of unfair or abusive returns, 3 Suisses reserves the right to refuse any future orders.


COMPLAINTS

To facilitate the processing of any complaint concerning non-guaranteed items, please contact us within 3 months of purchase.

GUARANTEES

LEGAL GUARANTEES

Independent of the commercial guarantee, 3 SUISSES commits to respecting its obligations relative to the guarantees attached to the products sold on its site and in its different catalogues in accordance with the regulations drawn from the following Consumer Code and Civil Code articles:


The seller is required to deliver a product that is conform to the contract and is held liable for any lack of conformity existing upon delivery. He is also held liable for any lack of conformity caused by the packaging or the assembly instructions, or the installation if he assumed responsibility therefore or had it carried out under his responsibility.

To be conform with the contract, the product must:


1. be suitable for the purpose usually associated with such a product and, if applicable:
- correspond to the description given by the seller and have the features that the seller presented to the buyer in the form of a sample or model;
- have the features that a buyer might reasonably expect it to have considering the public statements made by the seller, the producer or his representative, including advertising and labelling;


2. or have the features defined by mutual agreement between the parties or be suitable for any special requirement of the buyer which was made known to the seller and which the latter agreed to.

A seller is bound to a warranty on account of the latent defects of the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the buyer would not have acquired it, or would only have given a lesser price for it, had he known of them.

The action resulting from redhibitory vices must be brought by the buyer within a period of two years following the discovery of the vice.

Commercial Guarantee

The price includes all parts and labour.


The basic guarantee period varies according to the brand or item and is indicated in the sales description.


The guarantee does not apply to the normal use of certain pieces, nor to consumables, nor in the case of misuse or poor upkeep, nor in the case of professional or collective use, nor for damage coming from external causes (lighting, flooding, storms...)
